McColl Racing Enterprises – Warranty Policy

1. Overview

McColl Racing Enterprises (“MRE,” “McColl Racing,” “we,” “our,” or “us”) manufactures and supplies race cars, chassis, racing components, parts, and related services. This policy outlines MRE’s approach to warranties on products and services purchased from us.

Motorsports is inherently dangerous, and racing products are subjected to extreme forces, impacts, stress, and operating conditions. Customers must understand and accept the risks associated with racing and the use of racing equipment.

2. Warranty Coverage

Unless expressly stated otherwise in writing, McColl Racing Enterprises does not provide a general warranty on race cars, chassis, racing components, parts, or workmanship.

New McColl-built chassis and race cars are sold without an MRE warranty. No guarantee is made regarding product performance, durability, or suitability for a particular racing application.

Racing products may experience wear, damage, or failure during use. All warranty exclusions and limitations are subject to applicable law.

3. Manufacturer Warranties and Defects

Certain parts and components may be covered by a manufacturer's warranty. Where applicable, these warranties are provided by the respective manufacturer and are subject to its terms, conditions, and approval process.

If a customer believes a product has a manufacturing defect, they must contact McColl Racing Enterprises with proof of purchase and details of the issue. The product may require inspection or assessment to determine whether a defect exists.

Any replacement, repair, or refund will be determined based on the findings, applicable manufacturer warranty terms, and applicable law. Contacting MRE does not guarantee warranty approval.

MRE does not cover labour, removal, reinstallation, shipping, or other related costs associated with a manufacturer-approved warranty claim unless expressly agreed to in writing or required by applicable law.

4. Racing Risks and Customer Responsibility

Racing involves significant risks, including serious injury, death, and property damage. Racing products may experience wear, fatigue, damage, or failure due to impacts, operating conditions, maintenance, modifications, or other factors.

Customers are responsible for:

(a) Inspecting and maintaining their race cars and components.

(b) Ensuring products are installed, adjusted, and operated correctly.

(d) Ensuring equipment is suitable for its intended application and complies with applicable racing rules and safety requirements.

MRE does not provide insurance coverage for racing activities, vehicles, parts, or related risks. Customers are responsible for arranging any insurance they consider necessary.

5. Warranty Exclusions

To the extent permitted by applicable law, warranty claims may be excluded where issues result from:

(a) Normal wear and tear or consumable parts.

(b) Racing incidents, collisions, or impacts.

(d) Unauthorized modifications, repairs, or alterations.

(e) Misuse, neglect, or operation outside the product's intended application.

(f) Damage resulting from circumstances unrelated to a verified manufacturing defect.

Nothing in this section limits any rights or remedies that cannot legally be excluded under applicable law.

6. Relationship to Other Policies

This Warranty Policy should be read alongside MRE's Return Policy, applicable Terms of Service, and any written sales order, build sheet, purchase agreement, or manufacturer warranty applicable to the product or service.

Where a separate written warranty applies, its terms will govern the specific coverage provided, subject to applicable law.
